- 18+ Adults Only: Kinly strictly prohibits any form of Child Sexual Abuse Material (CSAM) or exploitation of minors within the app. Users under the age of 18 are not allowed to register or access the app. This is a platform designed exclusively for adults looking to connect and communicate. Any accounts found violating these rules will be permanently suspended and reported to relevant authorities if necessary. We fully comply with Child Safety Standards and international child protection laws.
- You're Responsible for Your Content: Anything you post or say on Kinly. is your responsibility. We don't actively monitor all content, but if we notice or receive reports about inappropriate material, we reserve the right to remove it and may suspend or delete your account.
- Respect Copyrights and Trademarks: Don't post content that belongs to someone else without permission. If you do and they file a complaint, you'll be responsible—not Kinly..

You can manage cookie settings in your browser or device, but If you disable Strictly Necessary Cookies, core functions such as login and security may stop working.
The Full Legal Bit
Kinly. is a social networking mobile application and website designed as a space for LGBTQ+ individuals to meet, communicate and build connections in a safe and inclusive environment. Our platform enables users to chat, join group discussions, events creation and share content with others. We want Kinly. to remain a fun, respectful, and secure place for everyone, so by using Kinly., you agree to use it responsibly and in accordance with these Terms of Use and our Community Guidelines (the "Terms").
When we mention Kinly., we mean the mobile app and the website thekinly.com, operated by WGF TECH s.r.o. (Prikop 843/4, Zabrdovice (Brno-stred), 602 00 Brno, Czech Republic).
These Terms constitute a binding legal agreement between you ("you," "your," or "user") and WGF TECH s.r.o. ("we," "us," or "our").
These Terms apply every time you access or use Kinly., regardless of whether you create an account. By accessing, using, or registering for Kinly., you agree to be bound by these Terms.
IF YOU DO NOT ACCEPT AND AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE APP OR WEBSITE.
1. Use of the App and Website & Rules Relating to Content
Who Can Use Kinly.?
- 18+ Only: Kinly. is exclusively for adults. You may only use Kinly. or create an account if you are 18 years or older (or the age of majority in your country if higher).
- Legal Compliance: You warrant that you have the right, authority, and capacity to enter into these Terms and that your use of Kinly. will not violate any laws or regulations in your jurisdiction. You are solely responsible for complying with local laws.
- Account Integrity: You may not share your account with others or use someone else's account. Each account must represent a single, real individual.
- No Criminal History: By using Kinly., you confirm that you have not been convicted of any offense involving assault, violence, sexual misconduct, or harassment.
1.1. What Kind of Content Can You Post or Upload on Kinly.?
Kinly. allows you to post various types of content, including profile photos, bios, messages, and other media ("Content"). While we encourage you to express yourself, we have strict rules on what content is acceptable.
You may NOT post, share, or upload content that:
- Is illegal or promotes illegal activities.
- Is harmful to minors or violates child protection laws.
- Is defamatory, libelous, or infringes on any third party's rights (e.g., copyright, trademark, privacy).
- Contains non-consensual images or videos of another person.
- Includes offensive language or imagery intended to harass, embarrass, or alarm others.
- Is obscene, pornographic, violent, or otherwise offensive to human dignity.
- Promotes racism, sexism, homophobia, transphobia, or any form of bigotry or discrimination.
- Relates to commercial activities (e.g., advertising, sales, contests) without our prior consent.
- Involves spam, scams, or malicious links.
- Contains viruses, malware, or any code designed to harm or interfere with Kinly..
- Impersonates another person or misrepresents your identity.
- Violates any part of these Terms or our Community Guidelines.
1.2. Content Responsibility & Moderation
- You Own Your Content: While you own the rights to the content you post, by uploading it to Kinly., you grant us a non-exclusive, royalty-free license to use, display, and distribute your content solely for operating and improving the app.
- You Are Responsible: You are fully responsible for any content you post. If you share content that violates these Terms or infringes on others' rights, you may be held legally liable.
- Content Monitoring: We use automated tools, user reports, and human moderators to review accounts and content for violations. We may remove any content or suspend accounts that breach these Terms without prior notice.
- EU & UK Users' Rights:
- EU Users: Under the Digital Services Act, we will notify EU users when we remove content or restrict accounts and provide an option to appeal.
- UK Users: You have the right to challenge content removals or account suspensions under UK consumer protection laws.
1.3. Reporting and Appeals
- Report Violations: If you come across content or behavior that violates these Terms, you can report it directly in the app or contact us at support@thekinly.com.
- Appeals Process: If you believe your content or account was wrongfully removed or restricted, you may appeal the decision within six (6) months of receiving the notice. To appeal, follow the link in the notification you received or reach out to support@thekinly.com
- Kinly. is under no obligation to disclose the reasons for banning a user if it is necessary to protect the community
1.4. Privacy and Personal Data
- Your Privacy Matters: Kinly. is committed to protecting your privacy. Refer to our Privacy Policy for details on how we collect, use, and safeguard your data.
- Don't Share Personal Info Publicly: You may not post personal contact details (e.g., phone numbers, email addresses, banking info) on your profile. Sharing personal information with others is done at your own risk.
- Respect Others' Data: You may only use other users' personal data in line with Kinly.’s purpose—connecting people. Using others' data for spam, harassment, or commercial purposes is strictly prohibited.
1.5. Visibility and Use of Content
- Public vs. Private: By default, content you upload (e.g., profile photos, bios) is public and viewable by other users. If you prefer more privacy, use in-app privacy settings to limit visibility.
- No Guarantees: While Kinly. prohibits screenshots and recordings of personal profiles, we cannot guarantee that other users won't attempt to capture your shared content.
1.6. License to Use Kinly.
When you use Kinly., we grant you a limited, personal, non-exclusive, non-transferable license to use the app and its features strictly for personal, non-commercial use. You may not:
- Copy, modify, or distribute Kinly.’s code or content.
- Reverse-engineer the app or website.
- Use the app in ways that violate these Terms.
If you breach these Terms, this license will terminate automatically, and you must stop using Kinly. immediately.
2. Ownership of Content
Do You Still Own Your Content After Uploading to Kinly.?
Yes — you retain ownership of the content you upload to Kinly., provided you are the rightful owner of that content. However, by posting, uploading, or sending content through Kinly., you represent and warrant that:
- You are the exclusive author or rightful owner of the content, and you agree to waive any and all moral rights related to it (including the right to be identified as the author).
- You have the proper license or permissions to use, post, or upload the content if you are not the original creator.
- You have obtained appropriate consent if your content includes or depicts any other person.
By uploading content to Kinly., you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, copy, modify, adapt, translate, and distribute your content solely for the purpose of operating, promoting, and improving Kinly.. This includes the right to:
- Edit or reformat content (e.g., resizing images, cropping).
- Promote Kinly. (e.g., using your content in promotional materials, with your explicit consent).
- Share content within the app as part of its features (e.g., public profiles, matching algorithms).
We may assign or sublicense this license to our affiliates or successors without further approval from you.
Intellectual Property Rights — Who Owns Kinly. Content?
All text, graphics, images, logos, sounds, and software within Kinly. (excluding user-generated content) are owned, controlled, or licensed by WGF TECH s.r.o. and are protected under international copyright, trademark and intellectual property laws.
You may not:
- Copy, modify, distribute, or sell any Kinly. content that you did not create.
- Reverse-engineer, decompile, or disassemble any part of the app or website.
- Use Kinly. content for commercial purposes without our explicit permission.
3. Paid Services and Subscriptions
Kinly. offers Premium Services designed to enhance your experience and help you connect more effectively. These services include:
- Exclusive Features:
- Access to private groups.
- Unlimited views of users who liked your profile.
- Ability to send messages to users before matching.
- Additional features aimed at improving visibility and engagement.
- Profile Boosting:
- Prioritized placement in search results and match queues to increase your profile visibility.
- Gifting Options:
- The ability to send virtual gifts to other users.
- Gift subscriptions to friends or matches directly within the app.
Purchasing Premium Services:
- Certain features may require identity verification (via our KYC process) before being unlocked.
- Premium Services can be purchased in the "Subscriptions" section after signing up.
- Gifts and gift subscriptions are accessible by tapping the gift icon on the "matching" screen.
Payments and Billing
- Payment Methods: You may purchase Premium Services through:
- App stores like Google Play or Apple App Store.
- Credit or debit cards.
- Other available payment methods (subject to your location).
- Billing Authorization: By purchasing Premium Services, you authorize Kinly. (or relevant app stores) to charge your chosen payment method. If payment fails, you agree to promptly pay any outstanding amounts.
- Auto-Renewal of Subscriptions:
- Subscriptions are automatically renewing (e.g., weekly, monthly, yearly) unless canceled at least 24 hours before the end of the current period.
- App store purchases must be canceled through your app store account (Google Play or Apple App Store). Deleting the app does not cancel your subscription.
- Pricing Changes: If we adjust subscription pricing, you will be notified and given the opportunity to cancel before renewal at the new rate.
Refund Policy
- General Rule: All purchases are non-refundable, and we do not offer refunds for partially used subscription periods.
- Exception for EU/UK Users:
- You may request a refund within 14 days of purchase if you haven't used the Premium Service.
- To request a refund, follow the respective app store's process or contact support@thekinly.com.
- Free Trials:
- Some Premium Services may offer free trials. If not canceled before the trial ends, your account will be billed automatically at the regular subscription rate.
- You can only access one free trial per user, per service.
Taxes and Withholding
- Prices for Premium Services may include applicable sales taxes or VAT based on your location.
- You are responsible for any withholding taxes or additional local taxes related to your purchase.
4. Access to the App and Website
Do We Guarantee That Kinly. Will Always Be Available?
Unfortunately, we cannot guarantee uninterrupted or error-free access to Kinly.. While we strive to keep the app and website running smoothly, there may be times when we need to perform maintenance or face issues outside our control (e.g., technical faults, network failures, or security incidents).
Kinly. is provided on an "as-is" and "as-available" basis, without any warranties regarding:
- Quality or performance.
- Availability or uptime.
- Accuracy or reliability of the content.
We reserve the right to suspend, modify, or withdraw parts of or the entire app or website at any time, without prior notice and without any liability to you.
What About Mobile Access?
- You are responsible for arranging the necessary services (e.g., internet, mobile data) to access Kinly. on your devices.
- Any charges incurred (e.g., data fees, roaming charges) from your internet or mobile provider are your responsibility. Kinly. is not liable for any costs associated with accessing the app.
- Reduced functionality: Some features may perform differently depending on your device, operating system, or network connection. We are not responsible for any limitations in app performance due to these factors.
Why Can't I Access Certain Features Without Registering?
- Non-registered users can only access publicly available sections of Kinly. (e.g., general app information, FAQs).
- To unlock key features — such as messaging, profile browsing, and participating in group chats — you must create an account.
- Some features or content may also be restricted based on profile completion or verification status (e.g., KYC verification via Didit). We may adjust these access requirements over time, at our discretion.
5. Termination of Use by You
How Do You Delete Your Kinly. Account?
If you've decided to take a break from Kinly. (or leave for good), you can delete your account at any time:
- Go to Settings within the app.
- Select "Delete Account" and follow the on-screen instructions.
What Happens After You Delete Your Account?
- 28-Day Restoration Period:
- After deletion, your profile will be deactivated, but we will retain your data for 28 days in case you change your mind.
- During this period, you can restore your account by simply logging back in.
- After 28 days, your data will be permanently deleted from our systems (subject to retention for legal or security purposes, as outlined in our Privacy Policy).
- Content Removal:
- Your profile, photos, and messages will be deleted upon account termination.
- User-generated content (e.g., messages sent to other users, comments in group chats) may still be visible even after your account has been deleted.
6. Abuse and Complaints
What Should I Do If Someone Violates the Terms?
If you come across any content or behavior that violates Kinly.'s Terms or Community Guidelines, you can report it directly through the app or by contacting us.
To report abuse or inappropriate content:
- In-App Reporting:
- Visit the user's profile.
- Tap the "Report" button.
- Select the reason for your report and provide any additional details.
- Customer Support:
- You can also submit a complaint by emailing us at support@thekinly.com with a detailed description of the issue.
We take all reports seriously and will review them as promptly as possible. However, while we strive to maintain a safe community, we cannot guarantee immediate removal of reported content.
If your complaint remains unresolved, EU users may be eligible to use the European Commission's Online Dispute Resolution (ODR) platform.
Are Other Users Vetted?
YES — BUT WITH LIMITATIONS.
Unlike many dating platforms, Kinly. takes user safety seriously by implementing KYC (Know Your Customer) verification through Didit. This helps verify user identities and reduce fake profiles or bots.
However, beyond KYC verification:
- We do not perform routine criminal background checks on users.
- We cannot guarantee the accuracy of user-submitted information (e.g., age, identity, or intentions).
Kinly. reserves the right to conduct background checks or screenings (such as sex offender registry searches) at any time, but we are not obligated to do so.
Safety Disclaimer:
While we promote a respectful community and offer tools to protect users, Kinly. cannot fully control user behavior.
By using Kinly., you agree that:
- You are solely responsible for your interactions with other users.
- You will exercise caution when communicating or meeting others in person.
- You release WGF TECH s.r.o., its affiliates, officers, directors, employees, and agents from any claims, losses, or damages (including personal injury or property damage) that may arise from interactions with other users.

7. Privacy Policy
How Is My Personal Data Handled?
Your privacy is important to us. Kinly. processes personal data in accordance with our Privacy Policy, which is an integral part of these Terms.
By using Kinly., you:
- Consent to the collection, use, and storage of your personal data as outlined in the Privacy Policy.
- Warrant that all information provided by you is accurate and up to date.
Our Privacy Policy explains how we handle sensitive data (e.g., sexual orientation, gender identity) and outlines your rights regarding data access, correction, and deletion.

- We do not endorse any third-party content, products, or services linked within the app or website.

9. Disclaimer of Warranties and Limitation of Liability
What If Someone Threatens Legal Action Because of My Actions on Kinly.?
If you breach these Terms or act in a way that harms another user, Kinly. will not be responsible for the consequences. You are fully accountable for your behavior and any content you upload or share on the platform.
We explicitly disclaim all responsibility for your conduct and the conduct of any other users on Kinly., including any disputes, claims, or damages arising from interactions with others.
Legal Limitations — What We Can and Can't Be Held Liable For:
Nothing in these Terms will limit or exclude our liability for:
- Death or personal injury caused by our proven negligence.
- Fraud or fraudulent misrepresentation.
- Any liability that cannot legally be excluded or limited under applicable law.
To the Maximum Extent Permitted by Law, Kinly. Disclaims:
- All warranties, representations, and guarantees (whether implied by law or otherwise) about the app and its services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Liability for any loss or damage you may suffer related to the use of Kinly., including but not limited to:
- Direct, indirect, or consequential damages.
- Loss of data, income, profits, or business opportunities.
- Losses caused by viruses, malware, or malicious code.
- Downtime, technical errors, or communication failures.
- Unauthorized access, theft, or data breaches.
This applies even if we were informed of the possibility of such damages.
Total Liability Cap:
In no event shall WGF TECH s.r.o.'s total liability to you for any damages or losses related to the use of Kinly. exceed €20.
Reliability of Kinly. and User-Generated Content:
We make reasonable efforts to keep Kinly. up-to-date and functioning, but:
- Kinly. is provided "as is" and "as available" without guarantees of accuracy or availability.
- We are not responsible for user-generated content, including errors, misleading information, or harmful materials posted by users.
- You are responsible for protecting your devices against viruses, malware, and other harmful code while using Kinly..
Although we strive to fix bugs and technical issues, we cannot guarantee that Kinly. will be error-free, uninterrupted, or secure at all times.
10. Indemnity
What If Someone Sues Kinly. Because of My Actions?
If your actions on Kinly. lead to legal claims against us, you agree to indemnify and hold harmless WGF TECH s.r.o. and its affiliates, officers, directors, employees, agents, and partners from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of Kinly. or its services.
- Any content you upload, share, or post on the platform.
- Your violation of these Terms or any applicable law.
- Your interactions with other users that result in harm or legal disputes.
How Will Kinly. Handle Legal Claims?
- We reserve the right to control the defense and settlement of any legal claims brought against us, even if they arise from your actions.
- You are required to fully cooperate with us in defending any claim.
- We may settle or resolve claims at our discretion, without needing your prior consent.
This section ensures that Kinly. is protected from liability arising from individual users' actions and maintains the platform's integrity.
11. Beta Programs
You may be invited to participate in a Kinly. beta program to test new features before public release. Participation is optional and at your own risk. These Terms of Use and our Privacy Policy apply to all beta programs, and WGF TECH s.r.o. reserves the right to modify or end any beta program at any time without notice.
Joining and Using Beta Versions:
- Beta access may require third-party platforms (e.g., Apple TestFlight) and acceptance of their terms.
- Only one version (beta or public) can be installed at a time. Installing the beta may lead to data loss—we recommend backing up your data before joining.
Exiting the Beta Program:
- You can leave the beta at any time via the platform used (e.g., TestFlight).
- Leaving the beta won't delete your Kinly. account, but app data from the beta may not carry over to the standard version.
Beta Purchases and Rewards:
- In-app purchases during beta may be free or discounted but often have accelerated expiration rates and won't transfer to the public app.
- Daily bonus credits may be offered but are temporary and may expire without notice.
12. Miscellaneous
Governing Law and Jurisdiction
These Terms of Use and any disputes arising from them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Czech Republic. Any legal proceedings related to these Terms will be subject to the jurisdiction of the courts in Brno, Czech Republic. However, if mandatory consumer protection laws in your country provide additional rights, those laws will apply.
In the event of discrepancies between the English version of these Terms and any translated versions, the English version shall prevail.
Changes to the Terms of Use
We may update or modify these Terms from time to time (a "Change"). When we do:

- We will update the "Effective Date" at the bottom of the Terms.
- In certain situations, we may notify you of significant changes via email or in-app notifications.
Continued use of Kinly. after any changes implies your acceptance of the updated Terms. If you do not agree to any changes, you should stop using Kinly. immediately.
Severability
If any part of these Terms is deemed invalid, illegal, or unenforceable by a competent court, that specific provision will be severed, and the remaining Terms will remain valid and enforceable.
Entire Agreement
These Terms represent the entire agreement between you and WGF TECH s.r.o. regarding your use of Kinly., superseding any prior agreements or understandings (whether oral or written).
No Waiver
Failure or delay by Kinly. in exercising any rights under these Terms does not constitute a waiver of those rights. Any partial or single exercise of a right does not preclude further exercises of that or any other right.
Third-Party Rights
These Terms are between you and WGF TECH s.r.o. No third party has the right to enforce any provisions of these Terms.
